Terms of Use

1. Acceptance of Terms

By accessing and using UnderText ("the App"), you accept and agree to be bound by these Terms of Use. If you do not agree, please do not use the App.

2. System Requirements

UnderText requires iOS 26.0 or later. The App will not function on older iOS versions due to dependencies on Apple's Translation framework.

4. Free Trial Terms (Yearly Plan Only)

• The yearly plan includes a 3-day free trial for new subscribers
• Full premium access during trial period
• You will be charged the annual subscription price after the 3-day trial unless you cancel
• Cancel anytime during the trial in App Store settings to avoid charges
• The monthly plan has NO free trial - payment is immediate

5. Subscription Management

All subscriptions are managed through Apple's App Store:

• Subscriptions auto-renew unless cancelled at least 24 hours before the current period ends
• Manage or cancel subscriptions in iOS Settings → [Your Name] → Subscriptions
• Cancellation takes effect at the end of the current billing period
• No refunds for partial months or unused portions

6. Payment and Refunds

• All payments are processed by Apple through the App Store
• Prices may vary by region due to local currency and taxes
• Payments are non-refundable except as required by law
• Refund requests must be submitted directly to Apple via the App Store

7. Supported Languages

UnderText supports exactly 20 languages:

English, Spanish, French, German, Chinese, Japanese, Korean, Italian, Portuguese, Russian, Arabic, Hindi, Vietnamese, Thai, Dutch, Polish, Turkish, Swedish, Indonesian, Greek

UnderText provides 6 keyboard layouts:

• QWERTY (English/International)
• QWERTZ (German)
• AZERTY (French)
• Spanish QWERTY
• Korean Dubeolsik (두벌식)
• Vietnamese Telex

9. Translation Services

UnderText offers exactly 2 translation options:

Apple Translation (Default)

• On-device, private translation (iOS 26.0+)
• No data transmission
• Available to all users (free tier: unlimited, Premium: unlimited)
• Always available as fallback (even when Premium AI tokens run out)

Azure OpenAI (Optional, Premium Only)

• Server-based AI translation service
• Requests go through our secure server
• No API keys required from you
• Premium subscription required
• Token-based daily quota

Token Usage & Fallback: Premium users receive a daily token quota for AI-powered enhanced translations. If you run out of tokens, the app automatically falls back to Apple Translation (on-device, unlimited) so you can continue translating without interruption.

10. User Responsibilities

You agree to:

• Use the App in compliance with all applicable laws
• Not attempt to reverse engineer or modify the App
• Not use the App for illegal or unauthorized purposes
• Safeguard your API keys if you configure third-party services
• Enable Full Access permission for keyboard features to work

11. Full Access Permission

UnderText requires "Full Access" keyboard permission to enable:

• Network access for Azure OpenAI (only if you configure your API key)
• On-device Apple Translation
• Speech synthesis for pronunciation
• Dictionary API for definitions

12. Intellectual Property

• UnderText and all related content are owned by the developer
• You may not copy, modify, distribute, or create derivative works
• All trademarks and logos are property of their respective owners

13. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, either express or implied, including but not limited to:

• Translation accuracy or quality
• Uninterrupted or error-free operation
• Compatibility with all devices or apps
• Availability of third-party services (Apple Translation, Azure OpenAI)

14. Limitation of Liability

To the maximum extent permitted by law:

• We are not liable for indirect, incidental, or consequential damages
• Our total liability is limited to the amount you paid in the preceding 12 months
• We are not responsible for third-party service issues (Azure OpenAI, Apple Translation)

15. Changes to Service

We reserve the right to:

• Modify or discontinue features at any time
• Update subscription pricing (existing subscribers are grandfathered)
• Change supported languages or keyboard layouts
• Update these Terms of Use (notification via app or website)

16. Account Termination

We may suspend or terminate your access if you:

• Violate these Terms of Use
• Engage in fraudulent activity
• Abuse or misuse the App

17. Governing Law

These Terms are governed by the laws of your jurisdiction. Any disputes will be resolved in accordance with local regulations and Apple's App Store Terms of Service.
